TRADE LICENCE

A trade license is a document/certificate that gives the permission to the applicant (person seeking to open a business) to commence a particular trade or business in a particular area/location. However, the license does not allow the holder to any other trade or business than for it is issued. Furthermore, this license does not pass on any kind of property ownership to the holder of the license

Documents Required to Apply for a Trade License

  • Form 353 duly filled
  • PAN card with incorporation certificate
  • No Objection Certificate from neighbour of business property.
  • Letter of consent or lease documents from the property owner.
  • The city survey map of the business property.
  • Tax receipts
  • Authorized layout plan of the premises, in case, if the business deals with explosives, timber, and dangerous goods.

Labour licence
Any contractor engaging 20 or more contract Workers is required to get labour license

Documents required

  • Form No.I- Application for Registration of establishment employing building workers
  • Copy of Form No.II i.e copy of certificate of Registration granted to the Principal Employer.
  • Form No.V- i.e. Certificate by the Principal Employer.
  • Form No.VI A- i.e Notice of commencement of contract work by the contractor.
  • Copy of agreement or work order entered in between the Principal Employer and contractor
  • Joint Undertaking both by Principal Employer and Contractor stating for payment of notified minimum wages to the contract labour engaged by them.

FSSAI

FSSAI is acronym for Food Safety and Standards Authority of India. It monitors, governs and lays down the rules and regulation for running the food business in India.

It is responsible for the registering and licensing of the food business operators (FBO) to assure the customers that the food made is secure and safe for consumption.

FSSAI has been established under the Food Safety and Standards Act, 2006 which is a consolidating statute related to food safety and regulation in India.

Documents required for Basic / State / Central Food License:

FSSAI Basic Registration
Basic registration is applicable for small-sized food business operators (FBOs) with annual turnover less than Rs.12 Lakh.

  • Form A has to be filled
  • PAN Card of the food business operators
  • 2 Passport Sized Photographs
  • Property Papers - if it is owned/ Rent Agreement
  • Partnership Deed
  • List of items that need to be manufactured, procured, packaged, etc
  • Certificate of Incorporation or Articles of Association (AOA) in case of a company

FSSAI State licence
The State licence is applicable for medium- sized food business operators with annual turnover more than Rs. 12 Lakhs or up to Rs.20 crores

  • List of Directors
  • Form-B has to be filled and attested
  • Proof of address
  • Details about Machinery
  • An identity proof that has a photograph
  • List of all food categories
  • A certificate of incorporation
  • The MoA and AoA of the business
  • Declaration and Undertaking by FBO
  • Utility bills of business place
  • NOC from Municipality or local body
  • Authority letter
  • FSSAI Self-Declaration for Proprietorships
  • NOC & Copy of License from manufacturer
  • Food Safety Management System Plan or certificate
  • Form IX: Nomination of Persons by a Company along with the Board Resolution

FSSAI Central License
The Central License is applicable for large business FBOs with annual turnover above Rs.20 crores. It is also required in cases where you need to supply at the government offices or import / export food products.

  • List of food categories planned to manufacture.
  • A certificate of incorporation
  • The MOA and AOA of the business
  • Declaration and Undertaking by FBO
  • Blueprint of the manufacturing.
  • Proof for turnover.
  • Authority letter with name and address of the responsible person nominated by the manufacturer along with the alternative responsible person
  • FSSAI Self-Declaration for Proprietorships
  • NOC & Copy of License from manufacturer
  • Food Safety Management System Plan or certificate
  • NOC from Municipality or local body and FSSAI
  • Form IX: Nomination of Persons by a Company with the Board Resolution
  • Import/export code issued by Directorate General of Foreign Trade(DGFT)
